Welcome to RTOR ("we," "our," or "us"). These Terms and Conditions govern your use of the RTOR platform, which connects chefs with customers seeking culinary experiences.
By accessing or using our platform, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.
2. Definitions
- "Platform" refers to the RTOR website, mobile application, and related services.
- "Chef" refers to individuals or entities who offer culinary services through our platform.
- "Delivery Partner" refers to individuals or entities who offer delivery services through our platform.
- "Customer" refers to individuals who use our platform to book culinary experiences.
- "Service" refers to the culinary experiences offered by Chefs through our platform.
3. Chef Responsibility
Important Notice for Chefs
Chefs using the RTOR platform are solely responsible for the quality, preparation, safety, and presentation of all food items they provide to customers.
As a Chef on our platform, you acknowledge and agree that:
Food Quality
You are solely responsible for the quality and freshness of all ingredients used in meal preparation.
Food Safety
You must comply with all applicable food safety regulations and maintain proper hygiene standards.
Allergen Information
You must accurately disclose potential allergens and provide complete ingredient information.
Compliance
You must obtain all necessary permits, licenses, and insurance required by local regulations.
RTOR's Role
RTOR acts solely as an intermediary platform connecting Chefs with Customers. We do not prepare, handle, or deliver food, and therefore assume no responsibility for the quality, safety, or presentation of meals provided by Chefs.
Delivery Partner Terms & Conditions
Important Notice for Delivery Partners
Please read the following terms carefully before using the RTOR platform.
1. Relationship Nature
- The Delivery Partner (“Partner”) is an independent contractor, not an employee, agent, partner, or representative of RTOR.
- Nothing herein creates an employer–employee, partnership, joint venture, or agency relationship.
- The Partner is free to work with other platforms.
2. Eligibility
The Partner must:
- Be 18 years or older
- Hold a valid driving license (if vehicle-based)
- Maintain valid vehicle documents (RC, insurance, PUC where applicable)
- Have a smartphone with internet access
- Maintain a valid bank account for payments
- Provide accurate, complete, and truthful information
The Partner is solely responsible for the authenticity, validity, and legality of all submitted documents and for maintaining them at all times. RTOR may verify documents at any time and may suspend or deactivate access if discrepancies are found.
3. Scope of Services
- Accept and complete delivery requests via the RTOR platform
- Deliver orders safely, professionally, and on time
- Follow instructions communicated through the RTOR app
- Maintain respectful conduct with customers and vendors
RTOR does not guarantee minimum earnings or order volume.
4. Order Acceptance, Rejection & Cancellation
- Partners may accept or reject orders
- Repeated rejections, cancellations, or delays may affect access to orders
- Once accepted, orders must be completed unless unavoidable circumstances occur
5. RTOR Payment System & Acceptance (MANDATORY)
- The Partner fully agrees to RTOR’s payment system, including:
- Per-order payouts
- Incentives, bonuses, surge pricing (if applicable)
- Settlement cycles (weekly / bi-weekly or as defined by RTOR)
- RTOR reserves the right to modify payment structures, incentives, or payout schedules
- Continued use of the platform signifies unconditional acceptance of the payment system
- The Partner shall not dispute or bypass RTOR’s payout calculations except through official support channels
- Any attempt to manipulate earnings, payments, or order values will result in immediate termination
6. Earnings, Deductions & Expenses
- RTOR may deduct platform service fees
- Penalties for misconduct, fraud, or policy violations
- Taxes or statutory deductions as required by law
- RTOR is not responsible for fuel, repairs, mobile data, fines, penalties, or personal expenses
7. Ratings, Performance & Conduct
- Partners are evaluated through customer ratings and internal performance metrics
- Prohibited conduct includes abuse, harassment, theft, tampering, fraud, fake deliveries, GPS manipulation, and substance use during deliveries
RTOR may suspend or permanently deactivate accounts for violations.
8. Safety, Driving Responsibility & Legal Liability
- The Partner is fully responsible for driving skills, road behavior, and traffic law compliance
- Any accident, injury, loss, damage, fine, or legal issue is solely the Partner’s responsibility
- RTOR shall not be liable for civil or criminal consequences
- The Partner agrees to indemnify and hold RTOR harmless from all claims or legal proceedings
9. Insurance Policy
- RTOR does not provide insurance by default
- Insurance, if offered, applies only after 45 continuous working days and subject to RTOR policies
- RTOR may modify or discontinue insurance at any time
- The Partner remains responsible for personal insurance coverage
10. Equipment & Branding
- RTOR may provide bags, uniforms, or identification materials
- All branded materials remain RTOR’s property and must be returned upon deactivation
11. Platform Usage & Data
- The Partner shall not misuse customer, vendor, or location data
- RTOR may collect real-time location data during active deliveries
12. Customer & Vendor Privacy (STRICT)
- Partners must not disclose addresses, locations, or contact numbers
- All communication must occur only through the RTOR app
- Any violation results in immediate termination
13. Safe Pickup from Homes & Private Locations
- Maintain professional conduct
- Avoid entering private areas unless permitted
- Prefer contactless pickup
- Leave immediately after pickup
14. Mandatory Safety Precautions
- Wear helmets and safety gear
- Verify orders outside residences
- Never record photos or videos at pickup locations
- Never store or share personal data
15. Zero-Tolerance Policy
- Data misuse
- Harassment or intimidation
- Safety violations
16. Suspension & Termination
RTOR may suspend or terminate platform access due to violations, fraud, complaints, or legal requirements. Partners may stop using the platform at any time.
17. Confidentiality
All non-public information must remain confidential, even after termination.
18. Amendments
RTOR may update these Terms at any time. Continued use implies acceptance.
19. Platform Disclaimer (CRITICAL)
RTOR acts solely as a technology platform and does not control or direct Partner actions.
20. Acceptance & Legal Acknowledgement
By registering and accepting deliveries, the Partner confirms full understanding and acceptance of these Terms & Conditions.
5. User Obligations
All users of the RTOR platform agree to:
- Provide accurate and complete information when creating an account
- Maintain the security of their account credentials
- Use the platform in compliance with all applicable laws
- Respect the intellectual property rights of others
- Not engage in fraudulent, abusive, or illegal activities
6. Liability
Limitation of Liability
RTOR shall not be held liable for any issues arising from the quality, safety, or delivery of food prepared by Chefs using our platform.
Customers agree that any disputes regarding food quality must be resolved directly with the Chef who prepared the meal.
To the maximum extent permitted by law, RTOR shall not be liable for:
- Any illness, injury, or adverse reaction resulting from food consumed
- Any failure of a Chef to comply with food safety regulations
- Misrepresentation of ingredients or allergens by a Chef
- Any delays, cancellations, or other service issues caused by Chefs
- Any personal or property damage occurring during culinary experiences
Chefs using the RTOR platform agree to indemnify and hold harmless RTOR from any claims, damages, or losses resulting from their culinary services.
7. Payments and Fees
RTOR charges a service fee for facilitating connections between Chefs and Customers. Payment processing is handled through our secure payment partners.
Chefs are responsible for setting their own pricing and agree to pay applicable platform fees as outlined in our Chef Agreement.
8. Termination
We reserve the right to suspend or terminate accounts that violate these Terms and Conditions or engage in activities that may harm our platform or users.
Chefs may be removed from the platform for repeated complaints about food quality, safety violations, or failure to maintain required certifications.
